Terms of Service

1. Acceptance of Terms

By accessing or using HiveSignal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

HiveSignal is a beekeeping management application that helps you track hive inspections, monitor colony health, and manage your apiary. The Service includes mobile applications, web applications, and related services.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscriptions and Payments

Practice Preview

A no-cost practice preview may be available so you can evaluate the workflow using example information. It does not create, store, or sync operational apiary records. A paid subscription is required to use HiveSignal with your own hives.

Paid Subscriptions

Paid subscriptions (Pro, Commercial) provide additional features and higher limits. By subscribing, you agree to:

• Pay all applicable fees for your selected plan
• Automatic renewal at the end of each billing period unless canceled
• Fees are non-refundable except as required by law

Cancellation

You may cancel your subscription at any time through your account settings or your app store account. Upon cancellation, you will retain paid access until the end of your current billing period. After that period, operational data may remain available read-only while new inspections, changes, and sync are disabled; the practice preview remains available.

Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice before price changes take effect.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service without permission
• Share account credentials with others
• Upload malicious content or code

6. Your Content

You retain ownership of the beekeeping data, photos, and other content you submit to the Service ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service.

You are responsible for Your Content and represent that you have the rights to submit it.

7. Intellectual Property

The Service, including its design, features, and content (excluding Your Content), is owned by HiveSignal and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

These recommendations are informational only and should not replace professional beekeeping advice, veterinary consultation, or your own judgment. We are not responsible for any decisions you make based on the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVESIGNAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless HiveSignal and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting support or using the account deletion feature. Data deletion is subject to our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the app. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HiveSignal operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HiveSignal regarding the Service.
